Ten Toes Firewood – Terms & Conditions of Sale

1. Orders

• All orders are subject to availability.
• Orders are confirmed once payment has been received, unless prior arrangements have been made.
• We reserve the right to decline or cancel an order at our discretion.

2. Pricing

• Prices are quoted in New Zealand Dollars (NZD).
• Prices are subject to change without notice; however, once your order is confirmed, your quoted price will be honoured.
• Delivery charges (if applicable) will be advised before your order is confirmed.

3. Payment

• Payment is due before delivery unless an alternative arrangement has been agreed to in writing.
• We accept bank transfer and any other payment methods advertised by Ten Toes Firewood.
• Overdue accounts may incur recovery costs and debt collection fees where permitted by law.

4. Delivery

• Delivery dates and times are estimates only and may change due to weather, traffic, mechanical breakdowns, or other unforeseen circumstances. These will be communicated to the customer at the time.
• Someone does not need to be home for delivery unless otherwise arranged.
• Firewood will be delivered to the safest accessible location determined by our driver.
• If access is unsafe or restricted, we may refuse delivery or deliver to the nearest safe location.
• Customers are responsible for ensuring there is suitable access for our delivery vehicle.

5. Delivery Access

• If a delivery cannot be completed because access is unsuitable, blocked, unsafe, or incorrect information has been provided, a redelivery fee may apply: $20 for town deliveries, $50 for inside the 40km circle, $100 for outside this range.
• Any damage caused by soft ground, hidden services, or unsuitable driveways where access has been requested is at the customer's risk.

6. Firewood

• Firewood is a natural product. Piece size, colour, moisture content, bark, and timber species may vary unless stated as DRY.
• Quantities are measured by volume at the time of loading. (Hand Thrown)
• Natural movement and settling during transport may occur.

7. Returns & Refunds

• Due to the nature of firewood, refunds or returns are generally not available once the product has been delivered.
• If you believe there is an issue with your order, please contact us within 24 hours of delivery and include photos where possible.
• We will work with you to resolve any genuine concerns.

8. Risk

Ownership and responsibility for the firewood passes to the customer once delivery has been completed.

9. Layby (if offered)

• Lay-by orders require the agreed deposit.
• Firewood will not be delivered until the balance has been paid in full.
• If payments are not maintained and no communication is received, we reserve the right to cancel the lay-by and retain a reasonable administration fee where permitted by law.

10. Promotions

• Specials, discounts, giveaways, and promotional offers cannot be combined unless stated otherwise.
• Promotions may end or change without notice.

11. Limitation of Liability

To the maximum extent permitted by New Zealand law, Ten Toes Firewood will not be liable for indirect or consequential loss arising from the use or supply of our products or services.

12. Consumer Guarantees

Nothing in these Terms & Conditions limits your rights under the Consumer Guarantees Act 1993 or any other applicable New Zealand consumer law.
